Integrated Genomics Files Suit to Defend Intellectual Property

CHICAGO, IL - March 1, 2007

Integrated Genomics (IG), a leading microbial genomics company, today announced that it has filed a lawsuit against two former employees for breach of their employment contracts with IG, including breach of their non-competition and non-solicitation obligations.

Nikos Kyrpides, the former Director of Bioinformatics at IG, and Natalia Ivanova resigned and took positions with the U.S. Department of Energy’s Joint Genome Institute (JGI), in Walnut Creek, California. The suit, filed in U.S. District Court in Chicago Illinois, alleges that Dr. Kyrpides, while still an IG employee, recruited other IG employees to accept positions at the JGI to develop a competing software system to IG’s leading ERGO™ Genomic Analysis software. The suit further alleges that both Dr. Kyrpides and Dr. Ivanova then proceeded to develop a competing software product while at the JGI in violation of their agreements not to engage in such activities.

"This is not the option we wanted to pursue" said Dr. Elling, President of Integrated Genomics. "We have spent considerable time and resources for over a year trying to reach an amicable resolution to these issues."

Integrated Genomics provides a full range of products and services to support research in microbial genomics, biochemistry and gene expression. These products and services are based on ERGO™, the company’s web-based genome analysis platform. Additional news and information about the company is available at www.integratedgenomics.com.
